You can fail a drug test from having sex with the wrong person.
Recently Legal DNA Testing came across a man in real distress. He had just had his children taken away because a drug test he is required to take monthly came back positive for methamphetamine and THC (marijuana). Now this man has had some addiction issues in the past, so it was no surprise to his babies mother, or even his own family that he had failed, even though it had been almost 2 years since he had used ANY drug.
A few days after the initial shock of having his children taken away had worn off, his girlfriend confessed that she had used both of those drugs and believed that because she experiences female ejaculation (which contains a significant amount of urine), that she may be the reason behind his false positive. The drug screening method was a hair sample that was taken from the pubic region and they had had sex literally 20 minutes before the test.
The question was, could her residual urine have caused the false positive for him? In order to answer this, we needed to find out if her DNA was in his hair sample.
It was as simple as contacting the lab to find out if they had any remaining sample from his test, they did. The sample was sent from their lab to ours and through a forensic analysis, Legal DNA Testing was able to prove that his hair sample did in fact contain her DNA and because female ejaculation is mostly made up of urine, it was enough evidence to convince everyone to allow him to take another test, which we are happy to say he passed, so he now has custody of his children once again.
Through our research into this situation to see if it was even possible for such a false positive on a drug test to happen, Legal DNA Testing came across several cases where other innocent people have had a drug test some back positive falsely and caused some very serious repercussions.
